This is a bad trend in legal scholarship that makes it hard to separate from politics, see, e.g. unitary exec theory and the civil service: "Oh, for 140 years, generations of lawyers, judges and Presidents simply misunderstood the nature of the constitution. Fortunately, we got in right."
