When we have a Congress again, we might need to revise the Federal Vacancy Act. 5 USC 3345(a)(2) allows the President to direct a person, who has already been appointed by the Senate to serve in an acting capacity. I am pretty sure Congress did not Marco Rubio to be the only employee in US Gov’t.
