SCOTUS just issued a unanimous ruling (by Kagan) on a police case: It reverses a Fifth Circuit ruling that had said a police officer had not violated the 4th amendment & used excessive force. SCOTUS says the appeals court is applying to narrow a test by only analyzing "the moment of the threat."
