Judges hear cases in open court, their judgments are public records, and their decisions can be appealed. Politicians and members of the public are entitled to comment and to criticise – robust debate is a sign of a healthy democracy. However it is crucial that any such criticism is based on accurate reporting. Criticism of judicial decisions that is based on a misunderstanding of the facts, reasoning or outcome of a case has a corrosive impact on public trust in the judiciary. It has also led to threats of violence against the judges concerned. Here ministers and parliamentarians have a particular duty to lead by example to maintain the public’s confidence in judges’ ability and integrity. The continuing independence of the judiciary is something which ought to be prized by every single member of the community.",
